Sequencing: what must happen in what order
Most failed investment visa files were perfectly legal property purchases. They just happened in the wrong order for immigration. Two of the four stations below cannot be revisited without unwinding the sale.
The four stations
- 1 · Money crosses the border correctly
Funds must enter through an intermediario del mercado cambiario (a Colombian bank or brokerage), in your name as sender or with a documented link to you, with the exchange declaration marked as international investment for real estate. This is the moment the state records that foreign money arrived and who it belongs to.
- 2 · Registration with Banco de la República retroactive fixes are limited
The declaration filed at step 1 becomes the foreign investment registration. Late or corrective registrations exist for some cases, but they are discretionary, slow, and a red flag on your later visa file. Do not treat this as paperwork you can catch up on.
- 3 · Deed at the declared value cannot be redone without a new sale
The escritura pública fixes the acquisition value forever. It must be at or above the visa line and it must reconcile with the amount registered at step 2. A deed for COP 562,816,750 with an "under the table" balance is not a visa-eligible purchase, whatever the seller told you.
- 4 · Application
Only now. Fresh certificado de tradición, Banco de la República registration, passport, the online form. Everything upstream determines whether this step is a formality or a rejection.
Timelines that break the sequence
Paying the promesa deposit from a foreign card or a friend's account
The arras (deposit) is often 10% or more. If it enters informally, that portion of the purchase is not registered foreign investment. Some buyers then register only the balance and end up below the line. Send the deposit through the same channel as the rest, in your name.
Buying before the money is in Colombia
Some sellers, especially of pre-construction, accept payments to accounts abroad. Convenient, and fatal for the visa, because nothing crossed the exchange market. If you are buying sobre planos with an investment visa in mind, route every cuota through Colombia.
Deeding to a company you have not yet formed properly
An SAS can hold property, but the visa looks for your investment. If the company owns the flat and your investment in the company is what was registered, the file is a different category and a different conversation. Decide personal name versus company before the wire, with a lawyer.
The January reset
The SMMLV changes every 1 January. A deed at COP 518,225,000 signed in December 2025 cleared the 2025 line by a comfortable margin and misses the 2026 line by COP 94,591,750. If your closing straddles a year end, close above the next year's expected line, or close before December and file immediately.

Whether a purchase completed in your name before you decided to seek a visa can be brought into compliance by a late foreign-investment registration depends on how the money originally entered and on the intermediary's willingness to file a corrective declaration. It is sometimes possible. It is never something to plan on.
